Modbee.com February 18, 2004 Prosecution told to turn over evidence --------------------------------------------------------------------------------10:49 a.m., PST: REDWOOD CITY -- A judge has ordered prosecutors to immediately turn over information that should have been provided to Scott Peterson's lawyers already. In court this morning, defense attorney Mark Geragos complained that prosecutors just recently gave him thousands of pages of information about several tests, the results of which could clear Peterson. He said the tests included examinations of what appeared to be blood spots in Scott Peterson's boat. The results showed the spots weren't blood, Geragos said. With hearings already under way in the double-murder trial, the delay in receiving the information makes it difficult for defense lawyers to thoroughly digest everything, Geragos said. Prosecutors admitted there was a lag, but said most of the tests weren't connected to the case. Judge Alfred Delucchi, however, ordered prosecutors to turn over everything immediately. He said if they do not to so to Geragos' satisfaction, he will set a deadline by which everything must be turned over or the prosecutors won't be allowed to use it as evidence at trial. In court cases, lawyers on both sides are obligated to turn over to the other any information they plan to use at trial. The process is called "discovery."
