MODESTO, California (CNN) -- Prosecutors in the murder case against Scott Peterson said Friday they want to buy his truck, which they contend he used to ferry the bodies of his wife and unborn son to San Francisco Bay, where they washed ashore in April.

Over objections from prosecutors, Stanislaus County Superior Court Judge Al Girolami has ordered that Peterson's truck, which police seized 11 months ago, be returned to him.

At at hearing Friday, Peterson -- who has been making $600 monthly payments on the Ford F-150 pickup -- smiled broadly but said nothing during the discussion over the prosecution's request to buy his truck at fair market value.

But his attorney, Mark Geragos, said, "So now the prosecution is in the used-car business."

The judge said he did not want to get involved, leaving it to defense attorneys and prosecutors to decide whether the truck will be sold. Geragos said the defense is willing to entertain an offer to buy the truck.

Girolami earlier agreed with the defense that the prosecution had had sufficient time to examine the truck and said prosecutors could use an identical truck for any demonstration to jurors.

In last week's court filing opposing the motion by Geragos to return the truck, prosecutors disclosed that they believe it was used to transport Laci Peterson's body to a warehouse rented by Scott Peterson and then on to San Francisco Bay. His blood was found in the cab, which investigators believe could have been the result of a struggle.

   You know, I saw that part of the court proceeding and I couldn't believe how arrogant MG and Scott were. Scott sat there smirking, eyes rolling and even laughed out loud when Geragos made the "used truck business" remark. Doesn't he remember he's being televised? I wonder what his family thinks of him now? I know if it were my son or brother I'd tell him to knock off the smirks - it's making him look worse.

If Scott has nothing to hide, just let the prosecution buy the damned truck for fair market value. They want it for some reason...

Of course, this is all just my opinion.

   Has anyone hard the status on the truck? Did the prosecution get to buy it afterall?

   ...the paperwork ? I haven't seen that announced. If interested try to verify with California Dept Motor Vehicles.

It was theirs if they wanted to purchase but why? The judge felt this was not necessary, they could have used videos, or a like vehicle. (view link) The prosecution is over their head in expenses on this case already, why use more of citizens hard earned tax money?

Because they obviously believe that there is evidence against Scott Peterson in the truck, and they want it available for trial. That is understandable and if they want to buy the truck, and the evidence can support their theory, then why not? If I were a tax payer in CA, I would support the prosecution buying the truck.

What would happen if they let it go and they somehow lost any photos that they had or needed for the case, stuff that could possibly prove him guilty, then a guilty man would walk free... Stuff like that happens, evidence is lost all the time. Less chance of losing a truck than of losing pics.

   ....much alike, politics and secure retirement involved. Who is the newly elected mayor of Modesto ? hmmm You will find name is a familiar name in this forum. So what happened to the former mayer who had the conversation with Scott while Laci was missing ?

I will not forget the term that was used by a California politician ' slam dunk ', the media frenzie that followed was overwhelming, accross the United States and around the world. It's no mystery, pat my back, I'll pat yours big time.

To answer your question: In my observation it would be further proof of sloppy investigation beginning, December 24, 2002 when Laci was reported to MPD as missing.

There is absolutely no reason to lose documents, pictures and/or negatives, reports or any information involved in this case.
NO ACCEPTABLE EXCUSE !
