11:35 a.m., PST: Wiretaps secretly recording Scott Peterson's telephone conversations while he was under police surveillance will not be used in his double-murder preliminary hearing, prosecutors said this morning.

Nor will they present anything having to do with tracking his movements by placing GPS tracking devices on his vehicles, Senior Deputy District Attorney Rick Distaso said moments after the long-awaited hearing got under way.

Scott Peterson, 31, is charged with murder in the deaths of his wife, Laci, and their son, Conner.

Judge Al Girolami will determine whether Peterson will be held for trial at the conclusion of the hearing, which began this morning in Stanislaus County Superior Court. Prosecutors are seeking the death penalty.

Laci Peterson was eight months pregnant when her family reported her missing Dec. 24. Scott Peterson told police he last saw his wife when he left for a solo fishing trip that morning as she prepared to take their dog for a walk.

The bodies of mother and son were found in April near the Point Isabel Regional Shoreline along the San Francisco Bay, a few miles from where Peterson said he went fishing. Police arrested Peterson April 18 in the San Diego area, where his family lives.

Also this morning:

Prosecutors indicated that they intend to call to the stand Laci Peterson's sister, Amy Rocha, and Marguerite Nava, Scott and Laci Petersons' house cleaner.

Girolami ruled that Los Angeles attorney Gloria Allred, who represents Peterson's former girlfriend, can remain in the courtroom as other witnesses testify.

Peterson's lead attorney, Mark Geragos, asked Girolami to order Allred out of the courtroom to prevent Allred from coaching Frey based on testimony of other witnesses.

Frey, 28, was Peterson's girlfriend when Laci Peterson disappeared. Frey has cooperated with authorities since learning that Peterson was married, and his wife was missing.

Girolami allowed Allred to stay but ordered her not to discuss any testimony from witnesses with her client.

"You can give her advice but you cannot include what witnesses have said," Girolami said.

All witnesses are kept out of the courtroom before testimony. Exceptions are the parents of Laci and Scott Peterson, and Rocha.

Prosecutors gave no indication of when they intend to call Frey to the stand.

Geragos said he intends to call a DNA expert from Shields State University in New York. The witness is expected to testify Monday, Geragos said.

Prosecutors began the preliminary hearing by calling Dr. Constance L. Fisher, an FBI expert on DNA analysis.

Fisher explained to a packed courtroom the difference between nuclear DNA, which is found in the nucleus of a cell and positively identifies tissues, and mitochondrial DNA, which is less reliable.

Analysts used mitochondrial DNA analysis to show that a hair found in pliers in Scott Peterson's boat may have been Laci Peterson's. That could be crucial if authorities attempt to show the boat was used to transport her body.

Peterson's defense team has challenged whether mitochondrial DNA analysis is reliable enough for use in court. Fisher was called to assure Girolami that it is reliable.

"The court will see that there is nothing new and novel in this particular type of technique," said Senior Deputy District Attorney Dave Harris.

Girolami earlier announced that he would allow defense attorneys to question the reliability. Wednesday, he noting that though California courts have accepted such DNA analysis, they haven't done so for cases involving forensic science.

1:40 p.m., PST: An FBI expert on DNA analysis continued testifying about mitochondrial DNA during the late morning session of Scott Peterson's preliminary hearing Wednesday.

Dr. Constance L. Fisher explained to a packed courtroom the difference between nuclear DNA, which is found in the nucleus of a cell and positively identifies tissues, and mitochondrial DNA, which is found elsewhere in cell an and is less reliable.

Mitochondrial DNA is passed down from one's mother, and all maternal family members share the same mitochondrial DNA, Fisher said.

For that reason, testing on a sample, such as hair, cannot reveal a person's specific identity, but if he or she came from a particular maternal line.

Scott Peterson, 31, is charged with two counts of murder in the deaths of his wife, Laci, and their son, Conner. Prosecutors are seeking the death penalty. At the conclusion of the preliminary hearing, Stanislaus County Superior Court Judge Al Girolami will determine whether to hold Peterson over for trial.

Analysts used mitochondrial DNA analysis to show that a hair found in pliers in Scott Peterson's boat was not his and may come from his wife. That could be crucial if authorities try to show the boat was used to transport Laci Peterson's body.

Peterson's defense team has challenged whether mitochondrial DNA analysis is reliable enough for use in court.

State law requires a special hearing to determine the validity of a novel scientific technique. On Friday Girolami approved such a hearing on the mitochondrial DNA issue.

He noted Wednesday that California courts have not accepted such DNA analysis in cases where it was offered for forensic evidence.

Prosecutors called Fisher to demonstrate that the process is generally accepted by the scientific community.

"The court will see that there is nothing new and novel in this particular type of technique," said Senior Deputy District Attorney Dave Harris.

"Children are learning this in high school," Fisher testified. "They're doing this in biology labs across the country."

For the bulk of the morning session, Fisher gave detailed testimony about the techniques, safeguards, and limitations for the testing - noting the process was more "sensitive" than typical nuclear DNA testing and that limited contamination of the sample typically occurred.

Fisher said mechanisms were in place to limit and monitor that contamination and maintain the integrity of the test.

At one point, a collective sigh of apparent relief was heard in court after Fisher concluded a lengthy explanation.

Fisher said the FBI conducted a validation study on mitochondrial DNA analysis in 1995 and began using the technique the following year. Labs are given proficiency tests roughly twice a year to verify accuracy, Fisher said.

She is expected to continue testifying Wednesday afternoon.

During her testimony, bailiffs handed notes to Scott Peterson's parents, Lee and Jackie Peterson, on separate occasions.

The couple sat with other family members in the front row behind the defense table. All Scott Peterson's family members appeared to were pins in the shape of a yellow ribbon overlaid with blue.

Pale yellow and blue ribbons were a near ubiquitous symbol during the massive search for Laci Peterson: the yellow to symbolize hope and the blue for the son Laci Peterson was expecting.

Does this mean that they cannot say for certain that the hair came from Laci, but they can say that it came from Sharon Rocha's offspring?

3:37 p.m. PST: FBI analysts compared a hair found in Scott Peterson’s boat to one of his blood samples and to DNA on a test swab designated as "SR2," an FBI specialist testified during Peterson's preliminary hearing this afternoon.
The hair did not match Peterson’s blood sample, contained on a test card, said Constance L. Fisher, an FBI expert on DNA analysis. The blood sample likely came when police obtained a warrant for Peterson’s "person."

The hair matched the DNA sample from the swab. Prosecutors did not specify in court where the swab sample came from, but mitochondrial DNA is passed down from maternal relatives.

Do these numbers seem low to anyone but me?

If I remember correctly the numbers in the Westerfield case were something line 1 quadrillion to 1 or something insane like that....

11:13 a.m., PST: FBI lab technicians had one of Laci Peterson's bones but did not extract DNA from it to compare with DNA from a hair found in her husband's boat, an FBI expert testified this morning.

The hair could be a key piece of physical evidence linking Laci Peterson to the boat her husband said he took fishing the day she was reported missing. Defense attorney Mark Geragos spent the first hour Thursday morning cross-examining FBI expert Dr. Constance L. Fisher about a disputed type of DNA analysis used on the hair.

It was the second day of a preliminary hearing against Scott Peterson at Stanislaus County Superior Court. The 31-year-old Modesto man is accused of murdering his wife, Laci, and their unborn son.

The defense contends mitochondrial DNA testing is unreliable and data from it should be excluded from court. Fisher has testified the process is more sensitive than commonly used nuclear DNA testing, but said it was scientifically sound and widely used.

She said comparing the hair to the bone wasn't necessary because analysts had a viable saliva sample from Laci Peterson's mother, Sharon Rocha, and that analyzing DNA from a bone was more difficult than from a saliva sample. Maternal relatives usually have the same mitochondrial DNA sequence.

Geragos also took aim at the computer program used to analyze the DNA data. Fisher said the program, written by a former lab employee no longer with the FBI, had some built in error but that analysts checked the results manually.

"Was he fired for incompetence?" Geragos asked.

Fisher said he left to study law, prompting the packed courtroom to erupt in laughter. Peterson, wearing a light gray suit and red tie, chuckled with nearly everyone else, then briefly shook his head from side to side as he smiled.

But much of the cross examination amounted to a two-person dialogue. During several stretches lasting many minutes each, Geragos stood two to three feet from Fisher, with Judge Al Girolami at times leaning over to look at their technical papers and reports.

Fisher, at times exasperated with Geragos' exhaustive cross-examination, rolled her eyes at a question just 16 minutes into the Thursday morning session. They bantered at times over things like definitions.

At least three armed bailiffs stood at two courtroom entrances at all times.

One member of Scott Peterson's family appeared to nod off shortly after 10 a.m., during questioning that was heavy on technical jargon regarding mitochondrial DNA analysis.

5:32 p.m. PST: A federal DNA expert concluded her testimony this afternoon after a second grueling day on the stand as Scott Peterson’s defense sought to show a disputed DNA technique is unreliable and should be excluded from court.

Judge Al Girolami is set to hear testimony Monday from a defense DNA expert before making a decision on the issue.

FBI lab technicians used mitochondrial DNA testing on a single hair found attached to pliers in Peterson’s boat.

The hair could be a key piece of physical evidence linking Peterson’s wife, Laci, to the boat her husband said he took fishing the day she was reported missing.

Laci Peterson was 27 years old and almost eight months pregnant at the time.

Scott Peterson, 31, is charged with murdering his wife and their unborn son, Conner. Prosecutors are seeking the death penalty.

The preliminary hearing is expected to continue Friday morning with testimony from Laci Peterson's sister and Scott and Laci Petersons' house cleaner.

At the conclusion of the hearing, Girolami will decide whether Peterson should stand trial on double-murder charges.

11:31 A.M., PST: Scott Peterson promised, but failed, to pick up a gift near the country club where he said he planned to golf on Christmas Eve, his dead wife’s sister testified at Peterson’s preliminary hearing this morning.

Peterson's pregnant wife, Laci, was reported missing Dec. 24. He told police he went fishing alone that day in San Francisco Bay, a few miles from where the bodies of his wife and son, Conner, were recovered in mid-April.

The offer to pick up a gift basket came as Amy Rocha, Laci Peterson's half-sister, cut Scott Peterson's hair the evening of Dec. 23, Rocha said on the witness stand. Both Petersons were involved in the conversation at the salon where Rocha worked, she said.

The gift was prepared at Vella Farms in north Modesto - not far from Del Rio Country Club, where Scott Peterson said he planned to golf Dec. 24, Rocha said.

Rocha said a Vella Farms employee called her near closing time because the gift had not been picked up. Rocha tried to call Scott Peterson's cell phone but couldn't reach him, she said, so she drove to the shop herself.

Also Friday morning, a house cleaner testified about her routine when she worked at the Peterson's Covena Avenue home, which she cleaned four times before Laci Peterson went missing. The last time was Dec. 23, Margarita Nava said.

Dennis Rocha, the father of Laci Peterson and Amy Rocha, sighed audibly twice during testimony. Laci Peterson’s mother and stepfather, Sharon Rocha and Ron Grantski, whispered frequently and at one point passed a note up to prosecutors conducting questioning at the counsel table.

Scott Peterson sat stone-faced throughout, at times conferring with his attorneys.

Rocha also testified that she regularly cut Scott Peterson’s hair, but her brother-in-law never asked her to color it.

Peterson’s hair and bushy goatee were tainted reddish-orange when he was arrested April 18, a few days after the bodies of his wife and son were recovered.

Attorneys on both sides asked many questions of Nava about pets in the house, which window blinds were normally closed and her routine regarding using rags to clean windowsills. The importance of the testimony was not immediately apparent but likely relates to trace evidence authorities gathered for forensic examination.

Nava, speaking through a Spanish interpreter, said she used bleach only to clean bathroom floors. She said she used water and “a little PineSol” to clean tile flooring in the kitchen.

Under cross-examination by defense attorney Mark Geragos, Rocha said that she and Laci Peterson had inherited a “substantial” amount of jewelry from their paternal grandmother. Laci attempted to sell some of the jewelry on the eBay online auction site, and in pawn shops, and wore some items, Rocha confirmed.

At that point in the testimony, Sharon Rocha removed a large metal earring from her left ear and held it for a minute or two, until Judge Al Girolami called a recess.

Rocha also detailed the clothing that Laci Peterson wore Dec. 23. Authorities believe she was murdered either that evening or the next morning.

Rocha said she had never seen or heard about Scott Peterson acquiring a fishing boat. She said he mostly spoke about golf when discussing hobbies.

Also in response to Geragos, Rocha said her sister generally was mobile, attending yoga classes and walking frequently. Defense attorneys are expected to develop a theory that the woman was snatched; Scott Peterson has said she was preparing to walk their dog when he left to fish Dec. 24.

12:50 p.m., PST: Laci Peterson's mother and Scott Peterson's father testified today about conversations they had with their children on Dec. 23 and 24.

Prosecutors called Sharon Rocha and Lee Peterson to the stand during the third day of a preliminary hearing against Scott Peterson. The 31-year-old Modesto man is charged with double murder in the deaths of his wife, Laci, and their son. Prosecutors are seeking the death penalty. At the conclusion of the preliminary hearing in Stanislaus County Superior Court, Judge Al Girolami will determine whether Peterson should be held over for trial.

Rocha said she spoke with her daughter briefly for a couple of minutes on Dec. 23 - the last time anyone other than Scott Peterson heard from Laci. She testified that Laci seemed tired, but said there was nothing wrong. Rocha also said her daughter never mentioned anything about marital problems.

Scott Peterson has acknowledged a romantic relationship with a Fresno woman, and said he told his wife about it.

When Lee Peterson took the stand, he said he spoke with Scott for about two minutes Dec. 24, the day Laci Peterson was reported missing. Scott Peterson told police he went on a solo fishing trip to Berkeley and could not find his wife when he returned that evening.

Lee Peterson said he talked to Scott in the afternoon, and Scott did not mention anything about having been to the Berkeley Marina that day. Lee Peterson also said he didn't know Scott had purchased a boat. Under cross examination by defense attorney Mark Geragos, Lee Peterson said that wasn't unusual and that in the past Scott had a purchased motorcycle, a catamaran and a truck without mentioning it to his father.

3:33 p.m., PST: Scott Peterson showed police a parking receipt from the Berkeley marina on Christmas Eve but didn’t respond when asked what type of fish he went fishing for, an officer testified today.

“He couldn’t say,” Det. Jon Evers said in Stanislaus County Superior Court during Scott Peterson’s preliminary hearing.

The 31-year-old Modesto man is charged with double murder in the deaths of his wife, Laci, and their son. Prosecutors are seeking the death penalty. At the conclusion of the preliminary hearing in Stanislaus County Superior Court, Judge Al Girolami will determine whether Peterson should be held over for trial.

Evers, who was a patrol officer at the time Laci Peterson disappeared, also testified that Peterson did not respond when his wife’s stepfather, an avid fisherman, commented that Peterson left late in the morning to go fishing in San Francisco Bay.

Evers said he was the first officer to respond to the missing persons report after dispatch notified him at 5:48 p.m. on Christmas Eve. Peterson told Evers he went fishing alone that day in San Francisco Bay, the officer testified.

The bodies of his wife and son, Conner, were recovered in mid-April along the bay’s eastern shore.

The technique used by the FBI laboratory is faulty and fails to adequately address contamination, said William Shields, a professor at State University in Syracuse, New York, who took the stand Monday in the fourth day of testimony in Peterson’s preliminary hearing on double murder charges.

Prosecutors contend mitochondrial DNA found in a test at an FBI laboratory determined the hair could not have come from Peterson, but may have come from his wife, Laci. The defense is trying to show the testing technique is unreliable and evidence derived from it should be excluded from court.

The hair could be a key physical link between Laci Peterson and her husband’s boat if prosecutors argue Scott Peterson ferried his pregnant wife’s body into San Francisco Bay and dumped it.

Peterson has been charged with two counts of murder in the deaths of his wife and son. Laci Peterson was almost eight months pregnant when she was reported missing Christmas Eve. Her body and that of her son were found in April about a mile apart along the bay’s eastern shoreline, several miles from where Scott Peterson said he went fishing the day she disappeared.

Shields testified Monday that FBI techniques didn't sufficiently take into account evolving genetic science and could wrongly conclude that a DNA sample could not have come from a specific individual.

Unlike nuclear DNA, mitochondrial DNA cannot be used as a unique identifier, but it can be used rule out that a sample came from a particular person.

According to Shields, contamination is “the biggest danger” when doing mitochondrial DNA testing because of the small sample amounts and procedures used.

He called a 1995 FBI study to determine contamination levels that wouldn't impact results “a very a bad experiment without statistical validity” because only five samples were tested.

Under questioning from prosecutor Dave Harris, Shields acknowledged he had never personally extracted a mitochondrial DNA sample in a lab, and garnered his expertise from reading reports done by others, viewing work in other labs and some of his own lab work.

Shields also said he would not testify as to whether mitochondrial DNA was “generally accepted” among the scientific community - calling that a legal term.

Under California law, evidence from a novel scientific technique can not be admitted in court unless a judge determines it is generally accepted by the relevant scientific community.

5:36 p.m., PST: Prosecutor Dave Harris sparred Monday afternoon with a defense expert over a disputed DNA testing technique in a contentious exchange marked by squabbling over definitions.

William M. Shields grew increasingly agitated with Harris in a string of exchanges about scientific terms and procedures, finally saying: “You’ve been doing this all along. Stop misrepresenting what I’m saying.”

At one point Judge Al Girolami asked Shields, a biology professor at State University in Syracuse, New York, to “calm down.”

“I’m sorry, your honor,” Shields said. “I’m sorry.”

Peterson’s defense team brought Shields in to testify about the reliability of mitochondrial DNA testing.

FBI lab technicians used the technique on a single hair found attached to a pair of pliers in Peterson’s boat.

FBI analyst Constance L. Fisher last week said the hair could not have been his but could belong to Laci Peterson. Fisher said the hair could have come from one in any 112 Caucasians.

Shields said Fisher used a faulty database to arrive at her conclusion, and recalculated that the hair could have come from one in any 11 Caucasians.

Peterson, 31, is charged with slaying his pregnant wife, Laci, and their son, Conner. Prosecutors are seeking the death penalty.

Prosecutors could try to show that the defendant used the boat to transport his wife’s body on Christmas Eve. The bodies of mother and son were recovered along the shore of San Francisco Bay in mid-April, a few miles from where Peterson said he went fishing alone Dec. 24.

Monday’s proceedings were broken off at several points as lead defense attorney Mark Geragos took calls regarding a Los Angeles murder trial he is handling.

The jury in that case was deadlocked on all but one of the charges after deliberating for six days, Geragos said outside court.

Girolami agreed to allow Geragos to appear Tuesday in Los Angeles in that case to address a question jurors had.

Veteran Modesto attorney Kirk is set to resume questioning police Detective Jon Evers on Tuesday in Geragos’ absence.

MODESTO, Calif. -- Modesto police officer Jon Evers said Tuesday he noticed a mop bucket and two mops in front of Scott and Laci Peterson's home as officers began investigating the pregnant woman's disappearance on Christmas Eve.

The officer said the mops were in plain view as he entered the modest single-story green-shingled house on Covena Avenue.

Another part:
Evers testified Friday that Peterson told his wife's stepfather that he scrapped his Christmas Eve golf plans because it was too cold, heading instead on the fishing excursion. Peterson told police he cut short the fishing trip because he became chilled as it started to rain.

Evers said another officer said Peterson didn't know what he was fishing for.

DRAGONFLY2 SAYS: TOO COLD TO GOLF, BUT NOT TOO COLD TO FISH? Being out on the water, you're more likely to get "chilly"......sounds like a fish story to me (pun very much intended).....

Modesto police Det. Al Brocchini also testified that Peterson never told him about the affair, part of a range of details to emerge Thursday during Scott Peterson's preliminary hearing.

Peterson, 31, is charged with murdering his wife, Laci, and unborn son, Conner. Prosecutors are seeking the death penalty.

Scott Peterson told police he returned from a day-long fishing trip to San Francisco Bay Dec. 24 to find his pregnant wife missing. Her body and that of her son were found in April several miles from the spot he said he went fishing.

Brocchini also testified Thursday that Peterson told him he washed his
clothes upon returned to home because they were wet from fishing and rain.

Brocchini said when he searched Peterson's truck Christmas Eve, he saw a blue tarp wrapped around umbrellas in the truck bed against the tailgate.

When asked about the umbrellas, Peterson said he was going to drop them off at a warehouse he used for his work but had forgotten, Brocchini said.

had "lost his wife," Frey told police after the pregnant Laci Peterson

morning.

Scott Peterson denied on Dec. 24 that he was having an affair, Brocchini
testified earlier this morning at Peterson's preliminary hearing on
double-murder charges.

Peterson told Frey in December that he was out of the country, that it was
his first holiday without his wife and that he "would be more exclusively
with her (Frey) after Jan. 25,"
Brocchini said Frey told him.

Peterson appeared to listen dispassionately as the detective testified.

Brocchini also said Peterson was arrested driving a maroon convertible
Mercedes. He used his mother's name when he bought the car with 36 $100
bills. And, Peterson had changed his appearance when arrested April 18,
Brocchini testified.

The seller told Brocchini he asked about Peterson's supposed name,
Jacqueline Peterson, and Scott Peterson said his parents gave him the name.
He said it was "a boy-named-Sue kind of thing," Brocchini said the seller
told him.

Scott Peterson's defense attorney tried Thursday afternoon to raise questions about evidence-gathering Christmas Eve, pressing a detective with questions about what officers did the night Laci Peterson was reportedmissing.

Detective Al Brocchini testified he seized a loaded .22-caliber handgun he found in the glove compartment of Scott Peterson's pickup and swabbed his hands to determine if there was any gun residue on them.

Those swabs were never tested, Brocchini said under cross-examination by Kirk McAllister. Brocchini appears to be at the center of a defense effort to suggest evidence was mishandled and potentially planted, and some of McAllister's questioning seemed an attempt to embarrass the detective or suggest incompetence.

MODESTO, Calif. — Two weeks before his pregnant wife disappeared on Christmas Eve, Scott Peterson told his new mistress he was a recent widower who would be spending his first holiday alone, a detective testified Thursday.

That same day, Peterson paid cash for the small boat prosecutors believe he used to dump Laci Peterson's body in the San Francisco Bay.

Those revelations were two of several bombshells from Modesto Police Detective Al Brocchini, the lead detective in the case.

Brocchini also told Superior Court Judge Al Girolami that Peterson placed affectionate calls to the mistress, massage therapist Amber Frey, in the days immediately after his wife vanished, promising they would soon be together.

"She heard from him on the 25th, the 26th, the 27th, the 28th ... saying he was out of the country and would be able to be with her more exclusively like Jan. 25th," Brocchini said.

The detective interviewed Frey Dec. 30 after she called a tip-line to report her relationship with the 31-year-old fertilizer salesman. Frey, who first met Peterson Nov. 20, may take the stand next week in the preliminary hearing to determine whether Peterson will be tried for the murder of his wife and unborn son.

In addition, Brocchini testified that:

*Peterson said his wife was mopping the kitchen as he left to go fishing on Dec. 24. Investigators found a damp mop and bucket outside the front door, but a maid previously testified that she mopped the entire home the day before and said Laci Peterson didn't usually clean between her visits. Relatives have said that at nearly eight months pregnant, Laci Peterson was frequently weak and tired.

   I think it's odd how the defense is trying to portray Brocchini as another "Mark Fuhrman-type" cop who began planting evidence, apparently they are trying to say he began doing this the very first day (remember them asking Det. Evers if he & Brocchini stayed together when searching the house that first day? And Evers said, no they weren't attached at the hip).

But on the first day, police were dealing with a MISSING PERSONS REPORT, not a murder. I find it an EXTREME stretch of the imagination that a "rogue cop" began planting evidence that early....

actually, the whole "rogue cop" thing is very distasteful to me...I'm sure nothing is impossible, but I just find it hard to believe in this case. And I think if a cop were to begin planting evidence, he'd do a better job than this....

Prosecutors have indicated that they will call Bruce Budowle, described as one of the "principal architects" of the FBI's DNA typing program, in a bid to counter defense arguments that the DNA test used by the FBI in the Peterson case is unreliable and should be excluded from court.

The preliminary hearing is scheduled to resume at 9:30 a.m. in Stanislaus County Superior Court in Modesto after a five-day break.

Video surveillance of Peterson home surfaces

: The federal Drug Enforcement Agency installed an 8-mm surveillance camera on Jan. 3 to monitor Scott Peterson's movements, and authorities have three roughly one-hour recordings of that activity, prosecutor Rick Distaso said in court Wednesday.

The camera was primarily used to monitor when the fertilizer salesman, who has since turned 31, left his home and then authorities would follow him, Distaso said.

The defense wants copies of the recordings in the event they contain information that could exonerate Peterson.

Defense attorney Mark Geragos said the camera and surveillance were apparently handled by a joint task force that involved the FBI, DEA, Modesto police and others.

He appeared to be referring to the Stanislaus County Drug Enforcement Agency, a joint task force that also handled two wiretaps on Peterson's phones.

Defense highlights computer trouble in DNA analysis

3:47 p.m. PST: The computer used to analyze DNA data from a hair found attached to pliers in Scott Peterson's boat malfunctioned four times during the test, but the glitches did not impact the results, an FBI expert testified Wednesday.

Bruce Budowle refused in court to call the glitches "problems," saying the process was simply re-run and produced valid results.

Budowle, on the stand for most of the seventh day of testimony in Peterson's preliminary hearing on double murder charges, had testy exchanges with defense attorney Mark Geragos, sometimes sparring over word definitions.

"When the machine malfunctions is that a problem?" Geragos asked.

"It depends on what you mean by problem," Budowle said.

"It didn't work," Geragos said.

Budowle responded that the machine ultimately did work and produce valid results. Those results showed the hair did not come from Scott Peterson but could have come from his wife, Laci, FBI analyst Constance L. Fisher testified earlier.

Amber Frey's role during investigation questioned

5:15 p.m. PST: Scott Peterson's girlfriend may have started taping their telephone conversations as soon as Dec. 16 - at least a week before his pregnant wife disappeared, courtroom drama revealed this afternoon.

Fresno massage therapist Amber Frey began cooperating with police Dec. 30. Modesto police Det. Al Brocchini testified that she said she didn't tape her chats with Peterson before then.

Defense attorney Kirk McAllister intimated that was "a lie," and asked Brocchini if he had heard that she began recording Dec. 16. The detective said no.

Frey, who has yet to testify at Peterson's preliminary hearing, has said she didn't know he was married when they met Nov. 20. Brocchini last week testified that Peterson told her about Dec. 9 that he had "lost his wife."

Brocchini said he gave Frey his tape recorder Dec. 30 and bought her equipment at a Radio Shack store so she could tape phone conversations.

Investigators hoped Peterson would not realize she was cooperating with authorities, the detective said.

Authorities discovered hair in pliers in February

11:35 a.m. PST: Authorities investigating the Christmas Eve disappearance of Laci Peterson stumbled upon a key piece of evidence - a hair in pliers in her husband's boat - while reviewing photographs in February, a detective testified this morning.

Prosecutors are trying to show that Scott Peterson used the 14-foot aluminum fishing boat to transport his pregnant wife's body after murdering her Dec.23 or 24, while defense attorneys say the evidence should be disallowed because testing on it was not reliable.

Modesto police Det. Al Brocchini testified this morning that he and Det. Craig Grogan discovered "pliers with a big long hair sticking out of it" Feb. 11 while reviewing pictures taken some weeks before.

Defense attorney Mark Geragos argued stridently that the picture should not be introduced as evidence in today's preliminary hearing because a copy of the picture provided to him was "overexposed" and "absolutely illegible." He said he had arranged for an expert to compare the print with film negatives on Tuesday.

Judge Al Girolami refused to stop Brocchini's testimony.

2:11 p.m., PST: Police in early January tailed Scott Peterson to SanFrancisco Bay three times, and the Modesto man briefly gazed out at the water before driving away in cars he had rented shortly before the trips,Detective Al Brocchini testified Thursday in Peterson's preliminary hearing on double murder charges.

Defense attorney Mark Geragos suggested during cross examination that
Peterson made the trips to check on search efforts for his missing wife, pointing to Bee articles that appeared on the days in question that detailed police search efforts at the bay.

Neighbor details finding Peterson's dog

3:31 p.m. PST: Next-door neighbor Karen Servas found Scott and Laci Peterson's dog running free with a wet, dirty leash still attached the morning of the day that Laci Peterson was reported missing, Servas testified this afternoon.

The account could undercut claims by potential defense witnesses who have said they saw Laci Peterson walking the dog on Christmas Eve after the time cited by Servas.

The timing is crucial because Scott Peterson told police that his pregnant wife planned to walk their dog after he left their Covena Avenue home at about 9:30 a.m. Dec. 24. He could be ruled out as a suspect if eyewitness claims regarding Laci Peterson walking her dog hold up.

Frey won't testify in preliminary hearing

5:23 p.m. PST: Laci Peterson's remains were found in April 14 clad in
tattered tan maternity pants with a 12- to 18-inch piece of duct tape
attached, a police detective testified Thursday afternoon in her husband's
preliminary hearing on double murder charges.
Peterson's sister, Amy Rocha, had earlier testified that Laci Peterson was
wearing tan pants the evening of Dec. 23. Laci Peterson was reported missing
the next day.

Sales records show Laci Peterson or her husband, Scott, had purchased a pair
of the same style tan maternity pants, Detective Phil Owen said.

Owen stared forward and appeared to clench his jaw when asked if he had
viewed the body.
"Yes I did," he said.

Owen, a 16-year veteran officer, gave the same three-word response when
asked if he had observed the autopsy, then his eyes turned downward.

Laci Peterson's mother, Sharon Rocha, got up and left the courtroom when the
questioning turned to the site were her daughter's body was found, the Point
Isabel Regional Shoreline along San Francisco Bay near Richmond.

MODESTO, Calif. — Two weeks after his pregnant wife went missing, Scott Peterson made three suspicious trips to the bay where her body was ultimately found, a detective testified Thursday morning.

Modesto Police Detective Al Brocchini, the lead investigator in the disappearance of Laci Peterson, said surveillance teams tailed Peterson to the San Francisco Bay Jan. 5, 6 and 9.

On each occasion, Peterson parked at the Berkeley Marina and "stared into the bay" for a few minutes before driving away, the detective told Superior Court Judge Al Girolami.

Later in the hearing Karen Servas, the Petersons' neighbor, offered a timeline of events that differs from the sequence Scott Peterson outlined to police.

Servas told the court that she came across the couple's dog, a golden retriever, standing in the street as she was backing her car from her driveway at 10:18 a.m. on the day before Christmas, the last day Laci Peterson was reported seen alive.

Servas testified that she got out of the car and escorted the dog, whose leash was covered with dirt, grass and leaves, to the Petersons' fenced-in backyard, and then drove off to do errands.


Amy Krigbaum, who lives across the street from the Peterson household, testified that she was making dinner for her family Christmas Eve when Scott showed up at her door and asked if she had seen Laci Peterson.

A snipit:
"He said he was golfing all day, and he had been trying to call her all day," Krigbaum recalled.

Defense issuing subpoenas relating to Frey

9:15 a.m. PST: Papers given to attorney Gloria Allred outside the Stanislaus
County courthouse Thursday afternoon were a notice from Scott Peterson's
defense attorney, The Bee has learned.

A paralegal from Mark Geragos' law firm handed Allred legal documents after
Peterson's preliminary hearing concluded for the day.

Those papers were a notice that the defense is subpoenaing documents from
other parties relating to Frey, Peterson's girlfriend at the time his wife,
Laci, disappeared.

Peterson is charged with two counts of murder in the deaths of his wife and
their son, who was to be named Conner. Prosecutors are seeking the death
penalty.
The preliminary hearing is set to resume at 9:30 this morning.

Expert: Hair fragments different shades of brown

1:56 p.m., PST: Two hair fragments that prosecutors contend came from a
single hair found attached to pliers in Scott Peterson's boat are different
shades of brown, the state Department of Justice expert who examined them
said Friday.

The pliers and a pair of wire cutters also examined at the DOJ lab in Ripon
appeared rusted, and there was no indication they had been used recently,
according to a sections of a lab report that was read in court Friday during
Peterson's hearing on double murder charges.

: Judge Al Girolami is leaning toward allowing mitochondrial DNA evidence in Scott Peterson's ongoing preliminary hearing, the judge said this afternoon.

But he agreed to hear one last argument from each side. Girolami did not say if he intends to issue a ruling when court adjourns for the day at about 4 p.m.

Police contend Peterson made cement anchors

3:44 p.m., PST: Police investigators found what one detective said was
evidence that multiple cement anchors had been made in Scott Peterson's
warehouse, Detective Dodge Hendee testified today.

Police found what appeared to be cement powder spilled on the edge of a
flat-bed trailer kept in the Modesto warehouse that Peterson used in his
work as fertilizer salesman and where he stored his 14-foot aluminum fishing
boat, Hendee said during Peterson's preliminary hearing on double murder
charges.

11:02 a.m. PST: Scott Peterson exchanged 241 cell phone calls with his lover in a 93-day period starting five weeks before his pregnant wife disappeared,an investigator testified this morning.

The two called each other nearly every day until Feb. 19, said Steve Jacobson, an investigator with the Stanislaus County district attorney's office.

They include seven calls on Christmas and a spike of 16 calls the next day. Conspicuous was a lack of calls between the pair Dec. 24, the day authorities believe Peterson dumped his wife's body in San Francisco Bay.

Peterson held over for trial

11:18 a.m. PST: Stanislaus County Superior Court this morning held Scott Peterson to answer on double murder charges in the deaths of his wife and son.

Judge Al Girolami's decision came at the conclusion of a 12-day preliminary hearing. Prosecutors are seeking the death penalty against the 31-year-old Modesto fertilizer salesman.

He is charged with killing 27-year-old wife, Laci, and their unborn son, who was to be named Conner. The bodies of mother and son washed ashore in April, a few miles from where Peterson said he went fishing on a solo trip Christmas Eve.
