   ...and we wonder why ? ..and why wasn't the gun included in the LE report? Why wasn't the forensic testing from Scott's hands or the gun completed ?

Danger lurks: Always take caution the route from the Peterson home on Covina, Modesto to the fertilizer warehouse on Emerald, West Modesto. For that matter caution everywhere.

Local NEWS Article November 24/03 Continued at link below:

" A security guard at Club Suave said he heard what sounded like a car backfiring about 12:15 a.m., so he went outside to look around, according to officer Chris Fuzie, a police spokesman.

Fuzie said the security guard found the wounded man lying in the parking lot and called police.

Club Suave is in the corner of a shopping center at Kansas and Emerald avenues, just west of Highway 99. It was the second shooting at the club in the past 17 months and the 17th homicide in Modesto this year, two shy of the record 19 in 1997."

LOCAL NEWS: Shooting claims Delhi man
A shooting outside a west Modesto nightclub left a Delhi man dead early Sunday, and by late afternoon police said they had no motive and no suspects.

   It may be that Scott, knowing that some of the chemicals he sold are also used to make Meth, felt the need to carry a weapon in case of robbery.

   I'm sorry but crimes in your neighborhood or possesion of a 'wanted' substance does not give anyone the right to carry a loaded weapon illegally. If things were so rough in his area he should have either moved or obtained a CCW permit.

People are shot all over this country everyday, we all do not break the law and arm ourselves.

I live in Los Angeles, believe me I've thought about it.

   It's my understanding the weapon was a 22 cal auto pistol. You can't get powder residue on your hand from fireing a 22 cal auto pistol.
It's difficult to get powder residue from any auto pistol on your hand.
Revolver, that's a different story. You can get powder residue on your hand from fireing a revolver.

   Police found a .22-caliber handgun in Peterson's pickup truck but they never revealed if it had been fired recently and a lead detective didn't know the results of gunpowder residue tests on Peterson's hands.

Why would they bother running the test, or taking the swabs if you cannot get gunpowder on your hands by firing this type of weapon?

I will do a bit more research, but I believe you can get residue from ANY weapon, and you don't even have to be the person that fired it.

They did swab Scott and it was then he asked if handling the boat motor would show up on the tests, however there was testimony that forensic testing was not completed. In fact the gun was not listed on the report...and they didn't know why.

Edited to add: Though I agree and it is against the law to carry a loaded gun, we may find there are more that do for their own protection than those that don't. From Covena Ave to and from the area of Emerald warehouse is not the safest in Modesto.

   It's very difficult to get gun powder residue on your hands fireing a 22 cal auto pistol. Auto pistols and rifles just don't put out powder residue like a revolver does. The chamber is closed except when ejecting a shell caseing. A revolver is open allowing the powder residue to get on your hand.
I don't know why they swabed his hand. I guess the person didn't know better.
