   Phone transcript: Peterson tells mistress of missing wife

On Jan. 6, 2003, Scott Peterson phoned his mistress, Amber Frey, to inform her of his wife's disappearance. What he did not know was that Frey was cooperating with authorities and Modesto police were recording their conversation. Below is a transcript of their call. Note: The transcript was reproduced by hand and may contain a few minor differences from the original.

Amber Frey: And ...

Scott Peterson: And I'm ... I'm so sorry that ... this has happened and I am so sorry I hurt you in this way. I don't want to do this over the phone. I want to tell you this, I want to be there in person to tell you this. But I'm ... sure that's why Saki called you.

AF: What?

SP: I'm sure that's why Saki called you.

AF: Why ... why would Saki ... what are you talking about?

SP: It's the worst thing. I'm sorry, Amber. Um ... well, I'll just ... I'll just tell you.

AF: Okay.

SP: You haven't been watching the news obviously?

AF: No.

SP: Um ... I have not been, traveling during the last couple weeks. I have ... I have lied to you ... that I've been traveling.

AF: Okay.

SP: The girl I'm married to ... her name is Laci.

AF: Um-hum.

SP: She disappeared, just before Christmas.

AF: Um-hum.

SP: For the past two weeks I've been in Modesto with her family and mine ... searching for her.

AF: Okay.

SP: She just disappeared, and no one knows ...

AF: Okay, now ...

SP: ... where she's been.

AF: Scott?

SP: And I ... I can't tell you more because I ... I need you to be protected from the media ... and Ayiana.

AF: Okay.

SP: Okay, they are amazing.

AF: Scott?

SP: Yeah?

AF: ... are you listening?

SP: I am.

AF: You came to me earlier in December and told me you had lost your wife. What was that about?

SP: She (unintelligible). She's alive.

AF: Where? She's alive? Where?

SP: In Modesto. Now, I know ... I've ... This is the hardest ... I ... I wanted to tell you in person. I ... here's ... you need to protect yourself from the media.

AF: Okay.

SP: Okay. If you even watch the news at all ... well, you haven't. Um ... the media has been telling everyone that I had something to do with her disappearance. So the past two weeks I've been hunted by the media. And I just ... I don't want you to be involved ... in this, to protect yourself. I know that I've, you know, I've destroyed. And I, God I hope ... I hope so much that ... this doesn't hurt you.

AF: How could it not affect me?

SP: It does. And I just ...

AF: How ... how ... can you possibly think this would not affect me?

SP: Amber, I know it does.

AF: Sigh.

SP: But I ... I ... I know I had ... I have just been torn up the last two weeks wanting to, tell you and I'm so weak that I haven't. And I just ... just hope that ... uh ... I had ... to call you and tell you that.

AF: You never ... you never answered my question, Scott.

SP: Sweetie, you don't ... you don't ... I can't ... I can't say any more.

AF: I think I deserve ...

SP: You deserve so much better. There's no question you deserve so much better.

AF: Yeah, and I deserve to understand an explanation of why you told me you lost your wife and this was the first holidays you'd spend without her? That was December 9th ... you told me this, and now all of a sudden your wife's missing? Are you kidding me?

SP: Yeah, she ...

AF: Did you hear me?

SP: I did ... I ... I ... I ... I don't know what to say ... I ...

AF: I think an explanation would be a start.

SP: I know you absolutely deserve an explanation, sweeties ...

AF: Yes, I do. I do.

SP: And I want to give you one.

AF: I'm listening.

SP: I ... I can't now. I mean you don't understand.

AF: ... But ... I don't understand why ...

SP: You don't understand ... the situation ... and ...

AF: Then why don't you fill me in on the situation and ... make me understand.

SP: I can't now. I'm so sorry for that.

AF: Why can't you? Why?

SP: It's ... to protect all of us.

AF: To protect all of who?

SP: Everyone involved.

AF: So where is she?

SP: That's what we are trying to find out. We have ... it's a nationwide search we have ... I mean it's a half million dollar reward for information leading to her safe return ...

AF: So again, you never answer my question. Why did you tell me ... it would be the first holidays without her?

SP: I can't, sweetie. I can't explain any more now.

AF: When can ...

SP: I'm so sorry you should be angry at me and God, I hope you are. I just ...

AF: Yeah, isn't that what you told me before, oh I wish, you know, I'd be so much easier if you'd just hate me and not want to talk to me. And of course, the rperson I am of course I'm gonna say, well, you know, you told me you lost your wife. You sat there in front of me and cried and broke down. I sat there and held your hand, Scott and comforted me and you were lying to me.

SP: Yeah.

AF: Again, lying to me about lying.

SP: I lied to you about traveling, yeah.

AF: That's ... among everything else. That's just an added.

SP: Yeah.

AF: So again, are you going ... is that you're not gonna answer the question.

SP: I want to.

AF: And what's stopping you?

SP: (unintelligible) things

AF: Why? Why would you tell me this on March (sic) 9th ... that you have lost your wife and I'm sorry I can't tell until after I get back to Europe and about this tragedy and I asked you are you ready for me? Oh, absolutely. This will be the first holidays without my wife. I'm going to spend them with my family in Maine. Is this not what you said?

SP: It is.

AF: It is?

SP: And I ... It is and I ... it is.

AF: And how do you explain all of a sudden you tell me it's a national search?

SP: It is, yeah.

AF: How is that just not such a coincidence?

SP: If you think I had something to do with her disappearance ... or it ... that is so wrong.

AF: Really?

SP: Yes, it is.

AF: And how there such a coincidence to that story from what you're telling me right now about what ...

SP: Well, no, sweetie ... I

AF: And you still have the audacity to call me sweetie right now? First, let's see, first Dave ...

SP: Amber?

AF: My friend Dave lies to me about his wife and I cried to you and tell you about this.

SP: I know, I know it. I'm ...

AF: And then you have the audacity to say how do you handle something like this. Are you kidding me? And to put me in the position ... and you want to protect me from the media. Why did you involve me in this? What ...

SP: I ... I ... haven't ...

AF: Role did I play? How long were you looking for me, Scott?

SP: I'm sorry?

AF: How long were you looking for me?

SP: Looking for you?

AF: Yes ...

SP: I don't understand ...

AF: Weren't you looking for me? Isn't that what you told Shawn you were looking for me ... or someone like me. How is ...

SP: I want to ...

AF: What ... I ... I ... I am just such at a loss right now.

SP: I know.

AF: You say you can't tell me, you want to tell me in person. At what point are you gonna tell me in person. At what point are you gonna tell me in person, Scott?

SP: Once we find her.

AF: What was that?

SP: Once we find her.

AF: Once we find her what?

SP: And that will be, I mean resolution and I will be ... I will be able to explain everything to you ...

AF: When you find her?

SP: I know you can't trust me, I know you can't trust me.

AF: Uh-huh.

SP: I could never ask you to do that.

AF: Okay, so how ... but didn't you ... didn't you say, "Amber, I will do anything to you to trust me. Uh ... baby we have ... I feel we have a future together." What was that about?

SP: I've never said anything to you that I didn't mean.

AF: You never told me anything you didn't mean?

SP: I lied to you about ... things I did.

AF: Uh-hum. So ... how am I going to stay out of this? How ... and ... and uh ... how do you see that happening? How do you see that I'm going to stay out of this or I'm not going to be dragged in or involved in this? How is that, Scott, can you answer me that?

SP: I don't know, but you ... I don't know, but you don't deserve to be.

AF: No, I don't deserve to be ... You're right.

SP: Exactly.

AF: I don't.

SP: Exactly. You do not deserve to be.

AF: So why did you drag ...

SP: You don't deserve to do the things that, I've done to you but ... there's no but, I'm sorry ... I want to explain everything to you

AF: Yes.

SP: But I can't.

AF: Why?

SP: Um ... primarily ... well there's a lot of reasons. Primarily protection for everyone.

AF: Protection of who?

SP: Everyone?

AF: Who is everyone?

SP: Everyone is you, me and our families.

AF: Everyone that would possibly look at you a little bit differently because why the hell am I? I ... I ... you know, you're telling me that we're ... Oh, I asked, is there anybody else? Oh no, I'm monogamous as far as I'm concerned.

SP: I never cheated on you.

AF: Ha, ha, ha (chuckling)

SP: I never did.

AF: You're married. How do you figure you never cheated on me?

SP: I want to explain to you, Amber.

AF: And ... you want to doesn't mean you're going to right? Is that ...

SP: I will. No, no, I will.

AF: When?

SP: I hope ... I God. I hope to hell that you will listen to me and that I can. I want to explain it to you so badly but I can't, now. And I, I hope and I can never ask you to ... to trust me or to even listen to me again.

AF: There's no way ... there's no way I possibly can.

SP: I know it. I can never ask you to do that for me. And I, I just hope that sometime in the future you will let me tell you the whole story. And I cannot ask you.

AF: You know what that ... that makes a lot more sense to me now, Scott.

SP: What's that?

AF: Of course you couldn't tell me the whole story about your wife because it hadn't happened yet. And you were hoping to resolve, in January, that it would be resolved and you'd have a story to tell me.

SP: Sweetie, you think I had something to do with her disappearance? Amber do you believe that?

AF: Well, let's see how can I believe that? How can I believe that? How could I believe anything for ... ?

SP: I am not ... evil like that.

AF: I would hope not.

SP: I am ... oh my God!

AF: You know you've lied to me now ... and, you know, ... you know, uh ... actually, you know, I was thinking um ... do you know how < > people I've given your picture to ... or of us, in Christmas cards? So you're telling me ... that you want to keep me out of this and Ayianna and you want to protect me from that. How ... I'm, I'm just ... I'm just so at a loss. I ... how ...

SP: Amber, I ... I had to tell you. I've been wanting to tell you. I hope in the future, I can tell you everything ... if you'll let me. I can never ask you to trust me and I am so sorry that ... I have ... I've, that this happened and this is happening to you. And that is uh ... just the truth. And ...

AF: You know what I met you ...

SP: It hurts ...

AF: It hurts me.

SP: ... it hurts me to believe that I could have something to do with her disappearance ...

AF: But, you know ...

SP: ... but I understand your anger.

AF: You know what actually ... I ... I've never ... I have not said that, those words have not came out of my mouth, Scott, now have they?

SP: No, but ...

AF: No they haven't.

SP: ... everyone has been pointing a finger at me and I just ...

AF: No, those came out of your mouth. And I'm not one to judge. There's only one.

SP: I know you aren't. But yeah, that's very true.

AF: But isn't that ironic how Scott, when I first met you on our date how you told me you were going to Maine with your family and you were going to Paris and Europe and all these things. And then you came to me after Shawn had found out that you were married and you came and told me this elaborate lie about her missing and this tragedy and that ...

SP: No.

AF: And that ... that this will be the first holidays without her?

SP: Sweetie ... I never said, Amber I ...

AF: Yes

SP: I ... God, I don't want to fight with you. Um ... you know that I ... I never said tragedy or missing.

AF: Oh, yes, you said you lost your wife.

SP: No. That ... that ... yes.

AF: You said obviously without me saying much, but we were.

SP: I said that I lost my wife.

AF: Yes, you did.

SP: I did. And yes ...

AF: How did you lose her then, before she was lost? Explain that?

SP: There's different kinds of loss, Amber.

AF: Then explain your loss?

SP: I ... I can't to you now.

AF: When can you?

SP: I can once there's ...

AF: ... when my name has been smeared all over, tabloids and everything else because I'm the ... the lover, I'm the girlfriend ... when you've had, when you've been married to this woman.

SP: You don't deserve that.

AF: No, I don't deserve this. And you've been faithful to me. Oh, I've, some people I tell I've been married and other people I say I never have because it's so painful for me.

SP: I've lied to you.

AF: Oh, more than, many times apparently, you know ... when you sat me down ... remember I said oh, I thought you were gonna tell me you were married?

SP: Right.

AF: So ...

SP: (unintelligible)

AF: ... so Scott, what about your baby? Laci's ... missing woman, pregnant, is that what you just said?

SP: Yes.

AF: Really? So is that why ... ?

SP: I want ... I want ...

AF: Yes.

SP: I want to explain all of this to you now.

AF: I'm listening.

SP: And I ... I just, am not able to.

AF: Why?

SP: I can't ask you to trust me, but you will ... if you give me a ... chance later to explain it.

AF: Later when? I'm listening right now.

SP: You will thank me for ... what's that?

AF: I will thank you for what?

SP: You will thank me for not explaining it now.

AF: Really?

SP: Not thank me, but you'll understand. And I can't ask you to ever listen to me. I can't do that.

AF: Well, I ...

SP: And this is the hardest thing ... you can't even believe that, I understand.

AF: Yeah, is that why you said you didn't want to have any children and Ayianna was the only child you ever see, of having and ... and at that point assuming we're together she would be ... you would have her as your own? Why would you tell me that when you were expecting a baby?

SP: Sweetie, I ... I'm so sorry that I can't tell you everything now.

AF: Why can't you tell me everything? Why?

SP: There is simply ... it just has entirely too many repercussions and they're not all for me.

AF: and you're what ... ?

SP: Okay, there's a lot ... and all the repercussions don't deal with me.

AF: What repercussions? What repercussions?

SP: If I was to explain, everything to you ...

AF: Yes.

SP: And you, you know, the media, started attacking you ... Or anything else, so many people would be hurt.

AF: You think?

SP: I know it. And ... I'm so sorry that you're being hurt by this.

AF: (sigh)

SP: But I mean I ... I can understand that you could never believe what I'm saying. I pray to God I just ... I hope you do, but I ... I can understand ... I'm so sorry.

AF: Tell me the coincidence of Laci, your wife, disappearing and your stories earlier in December? And then you ... you're carrying on this elaborate lie with me that you're in Europe ... and you're in Maine with your folks? Explain that to me?

SP: I wanted to tell you about this.

AF: Really?

SP: ... As ... as soon as it happened.

AF: But of course you couldn't because you were in Maine with your folks, huh?

SP: No, I didn't make that trip.

AF: So you know you and I

SP: I destroyed ...

AF: You and I assuming we'd be together, how would you have explained a new baby, that you ... brought into this world?

SP: I'm sorry ...

AF: How would you explain your baby, to me?

SP: Sweetie, you don't know everything.

AF: No, I don't so what ... what is it?

SP: I want to tell you everything but I can't tell you.

AF: Why can't you?

SP: About those things right now.

AF: Why? Why? Why not right now?

SP: It would hurt entirely too many people.

AF: Now, is this child yours?

SP: Sweetie ... I'm sorry, I keep saying that, you asked me not to. Amber, I cannot tell you.

AF: Is this child yours?

SP: I can't tell you all these things now.

AF: Why?

SP: The only ... the only things I, I just, I needed you to know and I hope that ... I hope um ... you are not ... you know, God, I, I, I think I know I hurt you.

AF: You know what?

SP: Amber?

AF: Yes.

SP: Amber?

AF: You know what?

SP: I just hope that I mean you don't get hurt more by this than I'm doing.

AF: You don't know what I've gone through. And for you to have ... no compassion for me.

SP: I hope you don't think that's true.

AF: You know actions speak louder than words?

SP: That's true.

AF: That's one for you to ponder on for awhile.

SP: It's true. I deserve anything you say, there's no question Amber.

AF: So tell me Scott ...

SP: Yeah.

AF: Why should I not go to the police with this?

SP: It's your decision.

AF: Really?

SP: Of course.

AF: And at that point uh ... I go to the police um (sigh) with this ... um ... what do you see happening?

SP: I imagine that ...

AF: Go ahead what?

SP: Well, I mean ... they would, you know um ... I don't know ... I don't know if they would, ah, release it to the media or, you know, obviously they would question you, they would want to know everything.

AF: Uh-hum.

SP: Uh ... I don't know ... I mean it's your decision of course ... Um, I wanted to tell you ... what has happened and I wanted to tell you that I lied to your ...

AF: And what stopped you from ... from this?

SP: Previous to now?

AF: Yeah.

SP: You know I could make excuses now to justify it to myself about ...

AF: You're not doing too great right now.

SP: Well, I know I'm trying. I justify it to myself by saying no, she just found out about Dave, no she just had a fight with her sister, don't tell her. No, no it was probably just weakness and hoping that I could hold onto you.

AF: Just a weakness and ... and holding onto me?

SP: Longing to hold onto you. And not being able to tell you about me traveling ... Amber?

AF: Yes.

SP: Are you there?

AF: Yeah, I'm here.

SP: I deserve everything that you want to say to me.

AF: Well, again, you know Shawn said ...

SP: I'm sorry. Amber?

AF: Are you forgetting things you had discussed with Shawn? If you're not serious about a relationship, don't call Amber. She ... she's been through too much already. Do you remember having this discussion with Shawn?

SP: Yeah, I do remember that.

AF: Uh, but you still went ahead and went through, why? Why? Are you there? Hello?

SP: Amber?

AF: Yes.

SP: Amber?

AF: Do you hear me? Are you driving? Hello? Hello? Are you driving? Hello? If you can hear me, call back. (beep)

   All she wanted was to know WHY he said he "lost" his wife BEFORE he actually LOST her...and he "couldn't" or really wouldn't tell her.

Why? Because the only reasonable explanation, the only TRUE explanation, is that YES, he did have something to do with her disappearance....and ultimately, her death. And of course that is not something he wanted to admit to, not to anyone.

As important as the phone transcripts are and available to any viewer who might in the future find themselves in a position to be called to jury duty in this case, and in order to be completely fair IMO, the phone transcripts should be EXACT in the words that were taped. What are the few minor differences ?

Where is the link to the above January 6 phone tap transcript ?

   You can find the transcript at www.courttv.com.

I don't know if that is where Dragonfly2 got it or not, but it is the same thing.

   Yes, that is where I got it.....

And I think in the above maybe what he was saying was that it hurts him to think that Amber could believe he would have anything to do with it- I don't believe there was anything that could be interpreted as a "confession".

When he said: "I am....oh my God!" I think he simply began to say something, stopped, and then said (or possibly GROANED) "Oh my God" in frustration at the whole conversation.

The thing about a transcript like this is that you cannot hear the tones of their voices or the inflection....

but what IS VERY CLEAR from this is that she wanted him to explain how he could say everything he told her on DEC 9th, and then have it actually come true two weeks later...how is that possible?

And it's also very clear that he was unwilling to explain it to her, that he was making promises of telling her "later" (which I doubt would have ever happened).....he didn't explain simply because he COULDN'T without confessing (IMO).

More lies, more covering up, that's all.....

   And by the way, I have snce found another copy of this same transcript that doesn't include the disclaimer about there possibly being a few minor differences- and they are exactly the same except for ONE word which didn't make a bit of difference in the context of it.....

"...During the conversation, Frey asked Peterson why she should "not go to police with this," Buehler said, reading from a transcript of the call.

It was unclear during the proceeding if Frey was referring to the couple's relationship or something else.

Peterson responded: "It's your decision," Buehler said.

Defense attorney Mark Geragos said that during hundreds of phone calls between the two, Peterson never sought to dissuade Frey from going to police.

"That's correct," Buehler answered...."
